29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a. On or about May 28, 2015, at the above located jobsite, employees applying mortar were exposed to the hazards associated with chemicals such as, but not limited to Portland Cement. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews:    a. On or about May 28, 2015, at the above addressed jobsite, employees were performing masonry operations from a tubular welded scaffold, approximately eighteen (18) feet above the ground, which was not provided with a complete guardrail system, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  a. On or about May 28, 2015, at the above addressed jobsite, employees performing masonry operations were exposed to falls approximately sixteen (16) feet created by the presence of unprotected sides.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:    a. On or about May 28, 2015, at the above addressed jobsite, portable ladders used to access the roof and third floor did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.
