29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    The employer failed to adequately instruct and train employees to recognize, avoid, and prevent hazards associated with trenching and excavation work.  The most recent example of this was on the demolition project, at or near the 700 block of Lemay Ferry Road, St. Louis, MO 63125, where the employer had inadequately instructed and trained employees to recognize, avoid, control or eliminate unsafe conditions and hazards relating to the following:      a)  Trench A, an approximate 7.5-foot deep trench lacked cave-in protection;  b)  Trench B, an approximate 7.3-foot deep trench lacked cave-in protection;  c)  Trench C, an approximate 6.4-foot deep trench lacked cave-in protection;  d)  Trench D, an approximate 6-foot deep trench lacked cave-in protection;  e)  Trench E, an approximate 9.5-foot deep trench lacked cave-in protection;  f)  Trench F, an approximate 8.3-foot deep trench lacked cave-in protection;  g)  Trench G, an approximate 6-foot deep trench lacked cave-in protection;  d)  on May 29, 2015 and times prior, workers were not removed from hazardous trench conditions until the trench conditions were corrected.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety:  On or about May 29, 2015 and times prior, the employer failed to have a competent person inspect the excavations.  Employees entered excavations without protective systems for excavations that measured between 6 and 9.5 feet in depth.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    At the job site, employees entered excavations without protective systems in place:    a)  Trench A, an approximate 7.5-foot deep trench lacked cave-in protection;  b)  Trench B, an approximate 7.3-foot deep trench lacked cave-in protection;  c)  Trench C, an approximate 6.4-foot deep trench lacked cave-in protection;  d)  Trench D, an approximate 6-foot deep trench lacked cave-in protection;  e)  Trench E, an approximate 9.5-foot deep trench lacked cave-in protection;  f)  Trench F, an approximate 8.3-foot deep trench lacked cave-in protection;  g)  Trench G, an approximate 6-foot deep trench lacked cave-in protection.
