29 CFR 1910.1200(h)(1) referenced by 29 CFR 1926.59: The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about was introduced into their work area: At the project, employees were not provided with effective information and training as employees said Laticrete Hydro Ban sealant was not hazardous despite being a chemical recognized by the state of California to cause cancer. In addition, the foreman said he was trained on the hazards of the chemical about 15 years ago while the date on the onsite material safety data sheet was 01/25/2007. Employees that applied the sealant with paint rollers and sponges and with sealant on their hands were exposed to the hazards of contacting a chemical recognized by the state of California to cause cancer.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: At the project, gloves were not worn while applying with sponges and paint rollers Laticrete Hydro Ban sealant on the concrete floor. Employees with sealant on their hands were exposed to the hazards of contacting a chemical recognized by the state of California to cause cancer.

29 CFR 1926.417(b): Equipment and circuits. Equipment or circuits that were deenergized were not rendered inoperative and did not have tags attached at all points where such equipment or circuits can be energized: In the room in back of the gift shop area, there were no tags on the 20 ampere circuit breakers 8 and 20 that were in the off position and that had been used to supply power to the wires in receptacle boxes in the gift shop area. The boxes were about 2 inches wide by 3 inches high and bottoms were about 23 inches above the floor. The wires were removed from the breakers and wire nuts were on the wires rolled up in the receptacle boxes. There were no covers or receptacles on the boxes. Harrah's Resort electrical maintenance staff had access to the panel and can reattach wires to the breakers in the panel. The door to the room and the door on the panel were not locked. W.E. O'Neil, the general contractor onsite, hired Anderson Howard Electric, Inc., to do the electrical installation work onsite. Anderson Howard Electric had locks on the breakers when they performed work on the equipment, and removed the locks when they finished their work onsite. W.E. O'Neil, the controlling contractor, did not ensure the breakers were locked out or tagged after Anderson Howard Electric left the project. Pfinish Koncepts dba Stone Craft employees, laying out the floor installation and using rollers attached to poles and sponges to apply sealant on the floor next to the receptacle boxes, were exposed to the hazard of contacting electricity.
