29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about June 2, 2015, at the Monticello construction site, two employees were observed working from a platform that did not provide any form of fall protection and were exposed to a fall hazard greater than 10-feet. The Platform (attached to the Genie/GHT-844 Telescopic forklift) had three vertical walls approximately 35 inches high, side to side was 8-feet and width 51 inches, the front of the platform left open (no wall).

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On or about June 2, 2015, at the Monticello construction site, two employees were observed working from a platform that did not provide any form of fall protection and were exposed to a fall hazard greater than 10-feet. Employees were not trained to recognize the hazards associated with the type of scaffold being used.
