29 CFR 1910.212(a)(1): One or more methods f guarding were not provided to protect the operator and other employees in the machine area from hazards created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.    a) On or about May 27, 2015, the employer did not provide guarding to protect the employees from contact with moving/rotating parts during the banding of metal coils on the Bradbury Double Ended Stockreel on Structural Line #9.  Employees were exposed to caught-by hazards associated with the banding operations.  Guarding methods such as barrier guards, two-hand tripping devices, tools to keep workers out of the danger areas or electronic safety devices (including keyed switches) or other effective means were not used.

The extension cord was suspended from the ceiling and then plugged into an electrical outlet on an adjacent column.    b) Production Area - The DeWALT compound miter saw (south) was used with an extension cord and not plugged directly into and outlet.   The extension cord was laid across the working walking surface and then plugged into an electrical outlet on an adjacent column.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    a) MBA Building Supplies, Inc. - The employer did not implement at the workplace a written hazard communication program in accordance with 29 CFR 1910.1200 that describes at least the following:    1) Requirement for labeling of containers of hazardous chemicals;  2) Safety data sheet(s) availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards of non-routine tasks; and,  6) Methods to inform other employer(s) of safety data sheets availability; the labeling system and any precautionary measures to protect employees.    Employees were exposed to hazardous chemicals including, but not limited to, Winzer Gloss black (8904001) spray paint (contains acetone, propane, n-butane, barium sulphate, glycol ether, methyl isobutyl ketone, methyl propyl ketone, xylene, PM acetate, isobutyl acetate), and Krylon laquer spray paint (contains acetone, toluene, propane, butane, naphthalene).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) On June 3, 2015, MBA Building Supplies, Inc. did not provide information and training to employees exposed to hazardous chemicals including, but not limited to, Winzer Gloss black (8904001) spray paint (contains acetone, propane, n-butane, barium sulphate, glycol ether, methyl isobutyl ketone, methyl propyl ketone, xylene, PM acetate, isobutyl acetate), and Krylon laquer spray paint (contains acetone, toluene, propane, butane, naphthalene).  b) On June 3, 2015, MBA Building Supplies, Inc. did not provide training to employees by December 1, 2013 that included an explanation of the revised safety data sheet (SDS) format and content, as well as the new labeling system elements, as required by the revised hazard communication standard.
