29 CFR 1926.20(b)(1): The employer did not initiate and maintain an accident prevention program as may be necessary to comply with the General safety and health provisions covered in 29 CFR 1926.20.  a)  On or about June 4, 2015, during roofing work, at a site located at 1586 Schaefer Circle, Appleton, WI 54915,  the employer had not developed and implemented a safety and health program that provided for frequent and regular inspections of the job site, materials, and equipment.  The employer also did not develop and implement a safety and health program to ensure that employees recognized and the proper procedures were followed for fall hazards greater than 6 feet, the proper use of ladders on construction sites, eye and head protection hazards.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  On and or about June 4, 2015, during roofing work, 1586 Schaefer Circle, Appleton, WI 54915, the employer did not ensure that each employee engaged in roofing work had been trained in the fall protection requirements to identify and implement conventional or personal fall protection while working on surfaces from approximately 11 feet to 19 feet and greater from the lower ground level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a)  On and or about June 4, 2015, during roofing work at 1586 Schaefer Circle, Appleton, WI 54915, the employer did not ensure that the orange portable Werner Non-Conductive Fiberglass ladder leaning against the garage was extended 3 feet to access upper landing surfaces and was not secured at the top of the ladder to prevent displacement.  b)  On and or about June 4, 2015, during roofing work at 1586 Schaefer Circle, Appleton, WI 54915, the employer did not ensure that the orange portable Werner Non-Conductive Fiberglass ladder leaning against the apartment complex was extended 3 feet to access upper landing surfaces and was secured at the top of the ladder to prevent displacement.  c)  On and or about June 4, 2015, during roofing work at 1586 Schaefer Circle, Appleton, WI 54915, the employer did not ensure that the silver portable TranzSporter fiberglass ladder leaning against the apartment complex was extended 3 feet to access upper landing surfaces and was secured at the top of the ladder to prevent displacement.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Each employee performing roofing work in excess of (6) feet above lower levels with unprotected sides and edges is not protected from falling by conventional fall protection equipment.  The employer does not require the use of any form of fall protection during roofing work.  This violation was most recently observed during residential construction at 1586 Schaefer Circle in Appleton, Wisconsin where four (6) employees were not protected from fall hazards of approximately eleven (11) to nineteen (19) feet to the ground on a high slope roof.  To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet high without adequate fall protection.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.
