29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface six feet (1.8 m) or more above a lower level where leading edges were under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail    On or About June 5, 2015    Location 489 3rd Ave, Brooklyn, NY 11215    A). Employees were not protected from falling more than 6 feet to the ground below when they were working beyond the guardrail system to secure a metal brace to the side wall of the adjacent project.  The employee was exposed to falling more than 14 feet to the floor below because he was not protected by any means of a personal fall protection system or guardrails.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    Location 489 3rd Ave, Brooklyn, NY 11215    On or about June 5, 2015    A). Employees engaged in hoisting structural steel from the ground level to the second and third floors were not protected from falls more than 15 feet to the surface below because they were not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    1). Employee was standing on the second floor balcony outside the guardrail area, guiding the hoist cable and steel as it approached from the ground below.    2). Employee was operating the hoist from the third floor and was not protected by any fall protection means while standing in the hoist way area.

29 CFR 1926.251(e)(1)(ii): Synthetic web sling(s) were not marked or coded to show rated capacities for each type of hitch:    On or about June 5, 2015    Location:  489 3rd Ave, Brooklyn, NY 11215    a). Employees were using a nylon sling in a chocker formation to lift ornamental steel stair parts from the ground to the third floor. The nylon sling was not labeled to indicate the rated capacity for each type of hitch.

29 CFR 1926.753(d)(2)(ii): Hooks with self-closing safety latches or their equivalent shall be used to prevent components from slipping out of the hook;     On or About June 5, 2015    Location 489 3rd Ave, Brooklyn, NY 11215    A).  Employees lifting ornamental iron stair parts from the ground to the third floor were not protected from struck by hazards because the hook on the electric hoist being used to lift the load did not have self closing safety latch, as it had been broken off sometime previous to June 5, 2015.
