29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): On or about April 10, 2015, the employer did not provide adequate machine guarding. The employees were exposed to the hazard of amputations. On or about April 10, 2015 and at times prior thereto, the employer did not ensure the point of operation on equipment were guarded: a. Employees were in use of 3 Piranha iron workers that did not have a guard at the point of operation, exposing the employees to caught-in and/or amputation hazards. b. Employees were in use of a shear that did not have a guard at the point of operation, exposing employees to caught-in and/or amputation hazards.
