The exposed employee was at heights greater than 24 feet. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: At this worksite, a safe means of access to the scaffold platform was not provided. An employee was observed climbing up and down on the scaffold frames as a means of access and egress. Mr. Del Toro was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 992144, citation number 1, item number 2 and was affirmed as a final order on 12/4/2014 with respect to a workplace located at Galic Rd and Business 83 Frontage Rd., Alamo, TX.
