29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a) All Around Roustabout, LLC @  Noble Energy, Colt-A 13-652, 648,645, Greeley, CO 80631:  On and before May 14, 2015 the excavating and exposing employer did not ensure that a competent person conducted an inspection(s) of the excavation, the adjacent areas, and protective systems for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, such as hazards posed by water accumulation before allowing employees to work in the unprotected sides of the excavation. The excavation was 5 feet deep and lacked any protective system, such as appropriate sloping, benching, or a shield system.  This condition exposed employees to a crushing hazard by excavation wall cave-in.  On May 14, 2015, at approximately 9:50 am, an employee was conducting activities inside the excavation at the east side when the unprotected excavation wall sloughed off and struck the employee resulting in a broken left leg.    Abatement note: The requirements and duties of a competent person are:    (1)        A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.    (2)        The competent person must understand and be able to carry out the tasks specified in the OSHA standard.  The competent person must also have knowledge about excavation protection systems or plans and the safety program.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):     (a) All Around Roustabout, LLC @ Noble Energy, Colt-A 13-652, 648,645, Greeley, CO 80631.  On and before May 14, 2015, as part of the injury/accident prevention responsibilities under its safety program, the excavating and exposing employer did not ensure that each employee performing activities inside the unprotected excavation at the east and west side was protected from a possible cave-in during the installation of an oil and gas flowline. The excavation was 5 feet deep and lacked any protective system, such as appropriate sloping, benching, or a shield system.  This condition exposed employees to a crushing hazard by excavation wall cave-in.  On May 14, 2015, at approximately 9:50 am, an employee was conducting activities inside the excavation at the east side when the unprotected excavation wall sloughed off and struck the employee resulting in a broken left leg.
