Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of an atmosphere with unknown levels of oxygen and/or accumulations of toxic gases/vapors while working in a confined space without implementing safe entry procedures: a) Manhole, Georgia Tech golf course located behind an apartment building jobsite, 455 14th Street, Atlanta- Employees were exposed to asphyxiation when the employer did not ensure that atmospheric testing was conducted prior to entering a sewer system manhole. The employees entered the manhole to inspect the piping of the sewer system and became unconscious while working in the confined space with unknown levels of oxygen and/or accumulations of toxic gases/vapors. b) Manhole, Georgia Tech golf course located behind an apartment building jobsite, 455 14th Street, Atlanta- Employees were exposed to asphyxiation when the employer did not ensure that a harness and retrieval device system was used prior to entering a sewer system manhole. The employees entered the manhole to inspect the piping of the sewer system and became unconscious while working in the confined space without non-entry rescue equipment.
