29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided: 1) R & M Drain & Waterproofing Inc. at 111 - 6th Ave., Superior, CO 80027: On or before June 4, 2015, the employer did not provide and ensure employee use of appropriate personal protective equipment in the following instances: a) The employer did not require the use of safety shoes meeting ANSI Z41.1 specifications when the employees used a jack hammer with a sharp edge to break up the clay; b) The employer did not require the use of safety glasses meeting ANSI Z87.1 specifications when the employees used a jack hammer to break up the clay, and when shoveling and pouring gravel; and c) The employer did not require the use of hearing protection with the use of the jack hammer. Conditions exposed employees to an amputation hazard, the hazard of projectiles to the eyes, and to the potential for hearing loss.

Condition exposed employees to fall hazards of up to 9 feet and to impalement hazards.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used: 1) R & M Drain & Waterproofing Inc. at 111 - 6th Ave., Superior, CO 80027: On or before June 4, 2015, the employer allowed the use of worn or frayed electric cords in the following instances: a) An orange extension cord was used to connect the jack hammer to the generator, and the extension cord had worn and frayed insulation; and b) The jack hammer had a worn and frayed cable that was taped up, but the tape did not keep water and moisture from degrading the insulation. Conditions exposed employees to a electrical shock hazards.
