29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Worksite located at 8010 162nd Street, Omaha, NE: Employees were observed conducting construction activities on a residential structure. The employees and foreman were exposed falls of 9 feet or more without using any form of fall protection such as a personal fall arrest system or other alternative methods. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Worksite located at 8010 162nd Street, Omaha, NE and throughout the company: The employer failed to retrain employees that were potentially exposed to fall hazards where they did not demonstrate an adequate understanding of the requirements outlined under Subpart M. Specifically, the employees must be trained to understand all of the provisions of the standard to include the heights at which fall protection is required. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
