29 CFR 1910.178(l)(1)(ii):     Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    On or about June 4, 2015, the employer failed to train operators as required by the powered industrial trucks standard, thereby exposing all employees to struck by hazards.

29 CFR 1917.50(c)(1): Each crane and derrick shall be tested as a unit quadrennially, and shall be examined annually. Certificates of tests and examinations shall be made readily available for inspection.    a. On or about June 4, 2015 the employer failed to perform quadrennially inspections on Linkbelt  LS338, crawler crane exposing employees to struck by hazards.      b. On or about June 4, 2015 the employer failed to perform quadrennially inspections on Linkbelt  LS518, crawler crane exposing employees to struck by hazards.    c. On or about June 4, 2015 the employer failed to perform annual inspections on Linkbelt  LS338, crawler crane exposing employees to struck by hazards.      d. On or about June 4, 2015 the employer failed to perform annual inspections on Linkbelt  LS518, crawler crane exposing employees to struck by hazards.
