29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5):      On June 9, 2015, employees were using a rough terrain forklift to move lumber around the job site and the employer did not ensure that each powered industrial truck operator was adequately trained and certified to operate a powered industrial truck.     Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    On June 9, 2015, employees framing a residential property were exposed to fall hazards up to 17 feet and the employer did not ensure that employees were utilizing fall protection.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
