29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  a) Second Floor Deck - A carpenter was observed ripping a sheet of plywood while using a Makita portable electric saw, model number 5007F, and not wearing eye protection, on or about 06/09/2015.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Second Floor Deck - Carpenters were observed on a plywood deck preparing to set a wood framed exterior wall without fall protection and exposed to an 11' 6" fall on to concrete or gravel, on or about 06/09/2015.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Job Site - Employees were not provided adequate fall hazard recognition training as evidenced by employees being on an open deck during a wood framing operation and no means of fall protection was in use, exposing the employees to an 11'6" fall hazard, on or about 06/09/2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
