29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: On or about June 11, 2015 and at times prior thereto, at this excavation site, employees were not trained in the following: A. Employees who were required to enter and work in trenches and excavations were not trained in how to recognize hazardous conditions. B. The employer had not designated and trained a person to be a competent person for trenching and excavation operations.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: At this excavation and at times prior, employees had worked inside a vertical wall trench setting in the storm drain pipe without a form of trench protection at a depth of 5 to 6 feet deep.
