29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). On or about June 10, 2015 an employee working for Kelley & Carpenter Roofing & Sheet Metal, Inc. was operating a power industrial truck that had not successfully completed the required training. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(n)(6): The driver shall be required to look in the direction of, and keep a clear view of the path of travel: On June 10, 2015 a Kelley & Carpenter Roofing & Sheet Metal, Inc. employee was operating a GEHL RS10-55 Telescopic Handler Forklift and failed to look in the direction of travel keeping a clear view of path exposing employees to struck-by and or crushed-by hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
