OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to drowning hazards while operating and repositioning an excavator on an unstable and overloaded floating landing craft/barge:  (a) Old Harbor - Block Island:  On or about 6/6/2015, employees were operating and repositioning a 78.4 ton Caterpillar 374 excavator on a 60 ton cargo capacity LCM-8 Landing Craft/Barge, which was overloaded and not properly secured to prevent it from capsizing.
