29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a) For employees working at 1101 Tamiami Trail in Port Charlotte on or about 5 June, 2015. Employees were working on an elevated work platform approximately 10 feet 2 inches above the concrete floor that was not guarded with standard railings and employees were not utilizing a personal fall protection system.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. a) For employees working at 1101 Tamiami Trail in Port Charlotte on or about 5 June, 2015, an employee fell approximately 10 feet 2 inches to the concrete floor and was hospitalized for injuries sustained. Employer failed to notify OSHA within 24 hours.
