29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On May 13, 2015, An employee was working in an excavation that was approximately 51 inches to 54 inches (4.25 feet to 4.5 feet) in depth without a ladder. The Eureka Construction & Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 315026773, citation number 1, item number 1 and was affirmed as a final order on 3/17/2011, with respect to a workplace located at Frontage and Farmore Roads, Jerome, Idaho.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On May 13, 2015, the spoil pile for an excavation measuring approximately 51 to 54 inches deep by 56 inches wide by 98 inches in length, was positioned on the edge of the excavation wall. This exposed the employee working in the excavation to the hazard of being struck by falling rock and dirt and increased the potential of a cave in. Eureka Construction & Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 107075, citation number 1, item number 1 and was affirmed as a final order on 12/5/2011, with respect to a workplace located at 100 Sunpeak Drive, Sun Valley, Idaho.
