29 CFR 1910.176(a): Where mechanical handling equipment is used, sufficient safe clearances be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. a) In the production area, on June 8, 2015, the employer did not ensure the safe handling of mechanical equipment, in the form of a forklift, that was transporting totes of produce from the warehouse to the production area adjacent to an employee occupied area, and required to complete a ninety degree turn to make entry into the production area from the aisle-way, exposing employees to struck-by hazards. OR IN THE ALTERNATIVE 29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled: a) In the production area, on June 8, 2015, the employer did not ensure the safe transport of stable and safely arranged double stacked, irregular shaped totes of produce by forklift, exposing employees to struck-by hazards.
