29 CFR 1915.81(b)(2): While a walkway or part of a walkway is being used as a working surface, the employer shall cordon off that portion to prevent it from being used as a walkway. 750 W. Berkley Ave., Norfolk, VA 23523, Pier 1: On or about May 22, 2015, and times prior thereto, the employer placed Port-O-Johns on pier 1 for employee use. The walkway directly adjacent to and in front of the Port-O-Johns was not cordoned off, employees and other workers exiting the Port-O-Johns were exposed to struck-by injuries. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
