29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. Jobsite: The employees, working and walking on the roof within very close proximity of unprotected skylights were not protected from falling through the holes/skylights by the use of personal fall protection devices, guardrail system, covers and/or other appropriate means. On or about June 11, 2015, one of employees, engaged in stripping the above roof fell approximately 22 feet 7 inches to lower level through one of skylights, and the employee sustained very serious injuries from the incident.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Jobsite: The employees who were exposed to fall hazards while working on the roof within very close proximity of the unprotected skylights were not re-trained in fall hazards posed by skylights and the procedures to be followed to minimize such hazards.
