29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    On or about June 15, 2015, at Pier One Imports, at Town Center at Creekside, New Braunfels, TX, the employer failed to ensure the employee(s) were not exposed to a fall hazard.  Employee(s) were using scissor lifts without installing the midrail chain in the back and were climbing out the scissor lifts onto the decking. The employee(s) were exposed to a fall hazard of approximately 20 feet to the ground below.

OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    On or about June 15, 2015, at Pier One Imports, at Town Center at Creekside, New Braunfels, TX, the employer failed to ensure the employees were not exposed to a fall hazard.  The employees were welding the decking and were working close to the edge.  The employee(s) were exposed to a fall hazard of approximately 20 feet to the ground below.
