29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system. (a) At the work site: On June 3, 2015, two employees working in an excavation were exposed to potential cave-in where the trench box was held approximately 5.75 feet above the bottom of the excavation. (b) At the work site: On June 4, 2015, two employees working in an excavation were exposed to potential cave-in where the trench box was held at a slanting height ranging from approximately two to three feet above the bottom of the excavation.

29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: (a) At the work site: On June 3, 2015, two employees working in an excavation were exposed to potential cave-in where the trench box was held approximately 5.75 feet above the bottom of the excavation where the manufacturer tabulated data indicated the box may be held two feet maximum above the bottom of the excavation. (b) At the work site: On June 4, 2015, two employees working in an excavation were exposed to potential cave-in where the trench box was held at a slanting height ranging from approximately two to three feet above the bottom of the excavation where the manufacturer tabulated data indicated the box may be held two feet maximum above the bottom of the excavation.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a) At the work site: On June 4, 2015, two employees observed working in an excavation were exposed to potential cave-in when leaving or entering the area protected by the steel box to access the earthen ramp where the walls of the ramp showed signs of fissure in the soil and a shield was not provided to protect the employees.
