29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.   a) On or about June 10, 2015 or prior thereto, at residential construction site at 1402 Bellerive Ln, in Coeur d'Alene, Idaho:  Stewart Construction Company, Inc., did not ensure that subcontractor employees were utilizing fall protection while working on a JLG rough terrain forklift, model 8042, with a mounted platform to access the rear deck of the home to install a 2nd floor window.   Guardrails were not utilized on the lift platform.  b) On or about June 17, 2015 or prior thereto, at residential construction site at 1402 Bellerive Ln, in Coeur d'Alene, Idaho:  Stewart Construction Company, Inc., did not ensure that subcontractor employees were utilizing fall protection while working on a JLG rough terrain forklift, model 8042, with a mounted platform to access a 1st floor canopy to install sheeting.  The eave height of the canopy was 13 feet.  Guardrails were not utilized on the lift platform.  Abatement certification and documentation is required for this item.

Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a) On or about June 17, 2015 or prior thereto, at residential construction site located at 1402 Bellerive Ln in Coeur d'Alene, Idaho:  Stewart Construction Company, Inc. did not ensure that subcontractor employees were not exposed to fall hazards while performing sheeting work on a 1st floor canopy with an eave height of 13 feet.  The employee accessed this working surface from a JLG rough terrain forklift platform that did not have guardrails.  Fall protection was not worn or utilized during this operation.  Abatement certification and documentation is required for this item.
