OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: On or about June 18, 2015, in the warehouse area, the employer failed to ensure at a minimum: (1) The manufacturer had given written approval to use the sofa crate. (2) Failed to ensure that required restraining means such as railings, chains, cable, body belt(s) with lanyard(s), or deceleration devices, etc., are in place and properly used. (3) There was means to securely attach the platform/crate to the lifting carriage or forks.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to getting their body or head crushed: On or about June 18, 2015, in the warehouse area, the employer failed to ensure the operators of the forklift were restrained. Employees were operating a forklift and were not wearing their seat belt. The employees were exposed to the hazard of getting their body or head crushed between the forklift and ground in the event of a tip over. The forklift was a Mitsubishi, Model FGC20N, serial AF82F01475.
