OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:     a) Cusick Tool, Inc. Hadley, PA  - On or about 6/18/2015 and at time prior thereto, employees were exposed to crush injuries, caught between, and struck by hazards from the operation of powered industrial trucks that were not equipped with operator restraint devices (i.e. seatbelts).  Employees operated the Caterpillar T70D forklift that was not equipped with a seatbelt.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a) Cusick Tool, Inc. -- Hadley, PA: On or about 6/18/2015, a lockout/tagout program consisting of energy control procedures (lockout/tagout procedures), lockout hardware, periodic inspections, authorized employee training, and affected employee training was not developed and implemented.  Employees conducted servicing and maintenance on machinery and equipment that included but was not limited to CNC machinery and various saws.

29 CFR 1910.176(b): Storage of material created a hazard:     a) Corner of Shop By Band Saws/Metal Storage: On or about 6/18/2015, strips of metal were piled on top of one another in a leaning position and were stored outside the confines of the metal storage rack.  The metal strips were not secured through other equally effective means to prevent overturning and falling.     b) Storage Area/Corner By Shelves Next to Office: On or about 6/18/2105, multiple cardboard boxes and boxes which contained paper products were not limited in height and interlocked to prevent collapse.  One of the boxes in the lower portion of the stack were twisted and leaning. The boxes ascended to a height of at least 5-feet above the cabinet.

Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:     a) Cusick Tool, Inc. Hadley, PA  - On or about 6/18/2015 and at time prior thereto, a jib boom fork lift attachment was utilized on the Caterpillar T70D forklift.  The attachment was utilized on the forklift for activities that included but were not limited to maneuvering metal pipes.  Forklift manufactures approval was not obtained to determine if the jib boom attachment could be utilized on the Caterpillar forklift.  In addition, the forklift's load/capacity plates were not changed to reflect the attachments effect on the forklifts capacity/stability.
