OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to excessive heat: On or about June 18,2015, at the above addressed jobsite, the employer did not develop and implement a heat illness prevention program for employees engaged in harvesting activities that were exposed to the hazard of excessive heat from factors such as, but not limited to, radiant heat from the sun and weather conditions.
