The employers two designated evaluators, the Human Resources and Shipping and Receiving Managers, were evaluators due to their position rather than their experience or knowledge.

29 CFR 1910.178(l)(3)(ii)(I): Powered industrial truck operators did not receive initial training on other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation: a) Atro Engineered Systems, Inc. @ 6 Bolte Lane, St. Clair, MO 63077: On and before June 18, 2015, the employer did not ensure that powered industrial truck operators were provided sufficient training to recognize hazards associated with the utilization of the Raymond 20i R3TT Reach Truck on the west loading ramp near the wooden pallet stacks. An employee suffered the amputation of three and a half toes on his left foot when the Raymond 20i R3TT Reach Truck uncontrollably slid backwards down the ramp, collided with a wire basket, and terminated at the landing gear of an over-the road tractor trailer.
