Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of crushing: On or about June 17, 2015, at the Hilton Lafayette/DoubleTree by Hilton Hotel Lafayette renovation site, an employee was exposed to crushing hazards while operating a Komatsu FG30HT-16 Pneumatic Forklift (Type G/LP, Serial# A231752) to stage pallets of materials without utilizing the seat belt provided by the manufacturer. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to, ensuring that the operator(s) of the Komatsu FG30HT-16 Pneumatic Forklift have read and understand the safety and operation instructions in the manual prior to operation, and utilize the seat belt provided during operation.
