29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. Throughout facility - On or about June 17, 2015, full time employees and temporary employees were required to maintain and / or repair equipment including, but not limited to, the "gallon machine" and the "tube filling machine." The employer did not establish a lockout/tag out program, consisting of the following: written procedures, periodic inspections, and employee training, thereby exposing employees to amputation hazards due to the unexpected reenergization of equipment.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those crated by point of operation, ingoing nip points, rotating parts, flying chips, and sparks. Examples of guarding methods are: barrier guards, two-handed tripping devices, electronic safety devices, etc. a. Production area - On or about June 17, 2015, Employees were required to operate the "gallon machine" on a daily basis. The employer failed to guard the point of operation at the feed point of the label machine. Employees were thereby exposed to the hazards associated with pinch points.

29 CFR 1910.212(a)(4): Barrels, containers, and drums. Revolving drums, barrels, and containers shall be guarded by an enclosure which is interlocked with the drive mechanism, so that the barrel, drum, or container cannot revolve unless the guard enclosure is in place. a. On or about June 17, 2015, employees were required to operate a tube filling machine in the production area on a daily basis. The revolving containers on the tube filling machine were not guarded by an enclosure which was interlocked. Employees were thereby exposed to struck-by, crushing, and amputation hazards.

Throughout the facility - On or about June 17, 2015, employees were required to operate powered industrial vehicles, work with and around chemicals, and operate machinery on a daily basis. These hazards necessitated the use of personal protective equipment, such as safety glasses, face shields, dust masks, and gloves to prevent occupational injuries. The employer had not verified, through written certification, that a hazard assessment had been performed.
