OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards:  On or about June 16, 2015, in the production area:  a) Employees performing sheet metal fabrication work were exposed to struck-by hazards while working with and in the vicinity of the crane marked CMC-017 that used a crane hook that had a missing safety latch.   b) Employees performing sheet metal fabrication work were expose to struck-by hazards while working with and in the vicinity of the 2-ton Budgit crane that used a crane hook with a safety latch that would not engage because it was the wrong size for the hook.

29 CFR 1910.243(c)(1): Abrasive wheel(s) were used on portable grinder(s) which were not provided with safety guard(s) meeting the requirements specified in 29 CFR 1910.243(c)(1) through (c)(4)(a):  On or about June 16, 2015, in the production area:  a) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 995033 that had the guard removed.   b) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 148588 that had the guard removed.   c) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 2010-21-47 that had the guard removed.  d) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 991605 that had the guard removed.   e) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 821552 that had the guard removed.   f) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 2008-29-47 that had the guard removed.   g) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 172244 that had the guard removed.   h) An employee performing sheet metal fabrication work was exposed to struck-by and amputation hazards while using a Dewalt 4.5 inch angle grinders, Model D28402 with serial number 941266 that had the guard removed.
