29 CFR 1926.1126(d)(2)(i): The employer did not perform initial monitoring to determine the 8-hour TWA exposure for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area. (a) Lucas Plumbing and Heating, Inc. 2125 West Park Street, Lorain, Ohio: On or about June 17, 2015, at the worksite located at 120 Pine Street, Elyria, Ohio, the employer did not conduct initial monitoring of employee exposure to hexavalent chromium (Cr 6+) while performing construction work. Employees performed construction work in hexavalent chromium regulated areas. Employees were exposed to hexavalent chromium and were at risk of adverse, serious health effects including but not limited to lung cancer, damage to the nose and throat, and irritation to the eyes and skin.

29 CFR 1926.1126(h)(4)(i): Whenever the employer allows employees to consume food or beverage at a worksite where chromium (VI) is present, the employer did not ensure that eating and drinking areas and surfaces were maintained as free as practicable of chromium (VI): (a) Lucas Plumbing and Heating, Inc. 2125 West Park Street, Lorain, Ohio: On or about June 17, 2015, at the worksite located at 120 Pine Street, Elyria, Ohio, the employer did not ensure that the area of the office used for eating and drinking was as clean as practicable. Wipe samples collected from the table in the lunch area revealed hexavalent chromium concentration of 0.3569 ug/100 cm2 (3.316 ug/ft2). Employees were exposed to hexavalent chromium and at risk of serious adverse health effects including but not limited to cancer and damage to the nose, throat and lungs.
