29 CFR 1926.20(b)(2): 29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.   405 Prospect Ave., Union Beach, NJ:  On or about 06/08/2015, the employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, five Solid Ground Masonry LLC employees excavated too close to and below the level of cribbing while demolishing the existing foundation/footing of a residence that was being lifted.  The employees were exposed to crushing and struck-by hazards.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   405 Prospect Ave., Union Beach, NJ:  On or about 06/08/2015, five Solid Ground Masonry LLC employees excavated too close to and below the level of cribbing while demolishing the existing foundation/footing of a residence that was being lifted.  The employees were exposed to crushing and struck-by hazards.  The employer had not instructed the employees to recognize and avoid unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards. 29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing or underpinning was not provided to ensure the stability of such structures for the protection of employees.   405 Prospect Ave., Union Beach, NJ:  On or about 06/08/2015,  five Solid Ground Masonry LLC employees excavated too close to and below the level of cribbing while demolishing the existing foundation/footing of a residence that was being lifted.  As such, the structure collapsed, exposing the employees to crushing and struck-by hazards.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
