OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by hazard:  On or about June 2, 2015, at the above addressed job site, an employee engaged in concrete cutting operation of an existing sidewalk was exposed to vehicular traffic and a proper traffic control pattern/zone in conformance with the Manual on Uniform Traffic Control Devices (MUTCD) was not used.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   On or about 6/22/15, at the above addressed work site, an employee was dry-cutting a cement sidewalk while wearing a respirator, which the employer did not provide a medical evaluation prior to using the respirator.  PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  On or about 6/22/15, at the above addressed work site, the employer did not ensure the employee was provided with effective information and training on silica prior to cutting cement.  PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
