29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Abimaell Elizondo dba Elizondo Roofing at 242 Welch Ct., Lyons, CO 80540: On or before June 16th, 2015 the employer did not ensure that employees were protected from falling off a sloped roof during roofing work. Employees were performing roofing work without the use of fall protection nor had the employer implemented an adequate fall protection plan. This condition exposed employees to fall hazards ranging from 10.3 feet to over 20 feet depending upon worker location on the roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Abimaell Elizondo dba Elizondo Roofing at 242 Welch Ct., Lyons, CO 80540: On or before June 16th, 2015 the employer did not ensure that all employees exposed to fall hazards of at least 10.3 feet onsite had received appropriate fall protection training. Training is performed to enable employees to recognize fall hazards and the procedures to be followed to minimize such hazards.
