29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On the site where a JLG Rough Terrain forklift was used to lift buckets of mortar up onto the scaffolding, the forklift operator was not trained in the safe operation of the rough terrain forklift thereby exposing employees to a struck/by hazard.

29 CFR 1926.151(c)(6): Portable fire extinguishing equipment, suitable for the fire hazard involved, shall be provided at convenient, conspicuously accessible locations in the yard area. Portable fire extinguishers, rated not less than 2A, shall be placed so that maximum travel distance to the nearest unit shall not exceed 100 feet. a. On the site where gasoline was used to power the Stow mortar mixer, the employer did not provide a fire extinguisher in the area where the mixer was operated with combustibles thereby exposing employees to a fire hazard.

29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus. a. On the site where masonry work was performed, the guard over the belt and pulley on the Stow Mortar Mixer was not guarded thereby exposing employees to a caught in hazard.
