29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. (a) Seaway Rd. Construction site - On or about June 10, 2015 about 855 A.M. an employee fell off a Caterpillar CS-563E Roller serial no. CNG1472-142. This employee was not wearing a seatbelt while operating the roller and fell from the vehicle sustaining serious injuries that resulted in hospitalization. (b) Seaway Rd. Construction site - On or about June 16, 2015 an employee was operating a Caterpillar CS-563E Roller without wearing a seatbelt. This employee was working on uneven earth where he could fall or be ejected from the vehicle.
