29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  The employer failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 for hazards associated with 1) employee exposure to noise above the permissible exposure limit 2) lack of a hearing conservation program and 3) lack of hearing protection provided and used by employees.

29 CFR 1926.52(b): Employees were subjected to sound levels exceeding those listed in table D-2 of 29 CFR 1926.52 and feasible administrative or engineering controls were not utilized to reduce sound levels:  a) On June 24, 2015, an employee removing a set of concrete stairs with a jackhammer was exposed to continuous noise levels at 189.2% of the permissible daily exposure (8-hour, time-weighted average sound level of 90 dbA or equivalently, a dose of 100 percent), during the 200 minute sampling period.  Exposure calculations include a zero increment for the 280 minutes not sampled. 94.60 dBA  b) On June 24, 2015, an employee removing a set of concrete stairs with a jackhammer was exposed to continuous noise levels at 292% of the permissible daily exposure (8-hour, time-weighted average sound level of 90 dbA or equivalently, a dose of 100 percent), during the 202 minute sampling period.  Exposure calculations include a zero increment for the 278 minutes not sampled. 97.70 dBA

29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered:  a) On June 24, 2015, an employee removing a set of concrete stairs with a jack hammer was exposed to continuous noise levels at 194.6% of the permissible daily exposure (8-hour, time-weighted average sound level of 85 dbA or equivalently, a dose of 50 percent), during the 200 minute sampling period.  Exposure calculations include a zero increment for the 280 minutes not sampled.   b) On June 24, 2015, an employee removing a set of concrete stairs with a jack hammer was exposed to continuous noise levels at 297% of the permissible daily exposure (8-hour, time-weighted average sound level of 85 dbA or equivalently, a dose of 50 percent), during the 202 minute sampling period.  Exposure calculations include a zero increment for the 278 minutes not sampled.

Exposure calculations include a zero increment for the 278 minutes not sampled.  The employee was not wearing hearing protection.
