29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):  (a)  At the worksite, a written hazard communication program had not been developed and implemented.  Employees were using Sure Kleen 600, a corrosive containing hydrochloric acid.  Employees were also mixing and troweling Spec Mix Mortar, a corrosive containing Portland cement, lime and crystalline silica.

(b)  At the worksite, the safety data sheet for Spec Mix Mortar, a corrosive containing Portland cement, lime and crystalline silica, was not available.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area (Construction Reference: 1926.59):  (a)  At the worksite, employees had not been informed of the requirements of 29 CFR 1910.1200; operations in their work area where hazardous chemicals were present; and the location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets.  Employees had not been trained on the methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.);  the physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area;  the measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, the details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.  Employees were using Sure Kleen 600, a corrosive containing hydrochloric acid.  Employees were also mixing and troweling Spec Mix Mortar, a corrosive containing Portland cement, lime and crystalline silica.

29 CFR 1926.50(g): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a)  At the worksite, an eye wash with at least 15 minutes of continuous flow was not available.  Employees were using corrosives such as, but not limited to, hydrochloric acid and Portland cement.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coatings, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees.  Such facilities were not in near proximity to the worksite and was not equipped as to enable employees to remove such substances:  (a)  At the worksite, adequate washing facilities were not available for employees using Portland cement.  Non-alkaline soap and clean hand towels were not available.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition when it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  (a)  At the worksite, employees applying Sure Kleen 600, containing hydrochloric acid, were not using goggles and/or face shields.
