29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about June 24, 2015, at the construction site on the east side of the apartment balcony where an employee was exposed to a fall hazard of more than 6 feet when performing caulking activities on a walking/working surface without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees on a walking/working surface 6 feet or more above a lower level are protected from falling.
