29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) though (vii) establish the types of fall protection to be provided to employees on each type of scaffold. Paragraph (g)(2) addresses fall protection for scaffold erectors and dismantlers: a) Two employees were exposed to 18 ft fall hazard when standing on the ladder jack scaffold platform without fall protection; employees were not provided FP harnesses and lifelines. Employer was replacing gutters on a 2.5 story house. Location: 1678 Ocean Pkwy, Brooklyn, N.Y. On or about 5/12/2015 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) Scaffold safety training was not provided to employees. Two employees were exposed to 18 ft fall hazard when standing on the ladder jack scaffold platform without fall protection; employees were not provided FP harnesses and lifelines.
