29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:     a)  At the site, on May 20, 2015, employees were not protected from accumulating water, approximately 1 foot,on the floor of a trench approximately 7.5 feet deep and 17 feet wide while probing to locate an existing underground installation.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:     a) At the site, on May 20, 2015, employees were exposed to struck by hazards when performing work inside a 7.5 foot deep trench where the south most spoil pile was not kept, at a minimum, 2 feet from the trench's edge.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:     a) At the site, on or about May 20, 2015, the designated competent person was not competent in that he did not know that the excavation required a protective system; he did not know spoils piles were required to be at least two feet from the edge of the excavation; he did not know the OSHA requirements for typing soil; and he did not know that water was not permitted to accumulate in excavations.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    a) At the site, on May 20, 2015,employees were exposed to engulfment hazards while working inside a 7.5 foot deep trench that was not equipped, or designed with, any protective systems while performing water utility work.
