29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design.   On June 25, 2015, and times prior thereto, at the west side of the construction site, employer did not ensure a welded frame scaffold was erected by a competent person in scaffold erection. Employees were allowed to work with the scaffold with a number of deficiencies, including but not limited to, the scaffold platforms were not fully planked, there was no means of egress, scaffolding was erected without mudsills or base plates and several of the cross-braces were missing.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.   On June 25, 2015, and times prior thereto, at the west side of the construction site, employees who erected a welded frame scaffold were not directed by a competent person in scaffold erection. The employees worked from the scaffold that was not fully planked, with no means of egress, without adequate base plate and were exposed to an unprotected fall of over 10 feet to the ground below.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports.   On June 25, 2015, and times prior thereto, at the west side of  Lubbock Emergency Communication District's building, employees were exposed to fall hazards when working from the second tier of a scaffold that was not fully planked.

On June 25, 2015, and times prior thereto, at the west side of the construction site, scaffolding was erected with split planks that affects the load capacity, exposing employees to fall hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.   On June 25, 2015, and times prior thereto, at the west side of  the construction site, employees were exposed to fall hazards when working from the second tier of a scaffold without guardrails.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as used as a means of access.   On June 25, 2015, and times prior thereto, at the west side of Lubbock Emergency Communication District's building, employees were exposed to fall hazards when accessing the second tier of the scaffold when a ladder was not provided.
