29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b)or(c): (a) Len's Excavating @ 2715 17th Street, Denver, CO 80211: On and before June 23rd, 2015, the employer did not ensure that each subcontractor employee pouring concrete inside of a trench was protected from cave-ins by an adequate protection system. The trench measured 5.5 feet in depth and lacked an adequate protective system. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a)Len's Excavating, 2715 17th Street, Denver, CO 80211: On and before June 23rd, 2015, the employer did not ensure that daily inspections of the excavation, that measured 5.5 feet in depth and did not have an adequate protective system. The spoil pile was approximately 3 inches from the edge of the excavation. The excavation walls had visible cracks and fissures, in addition to concrete blocks in the spoil piles of the excavation. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in.
