29 CFR 1910.178(l)(1)(i) This provision is applicable to construction employment by 29 CFR 1926.602(d). 29 CFR 1910.178(l)(1)(i): The employer failed to ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Throughout the Company: The employer failed to ensure that the employees received the training required prior to operating a powered industrial truck. In this case, a Lull all terrain fork truck was being used to elevate a personnel platform and move materials. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.

29 CFR 1910.178(l)(1)(i) This provision is applicable to construction employment by 29 CFR 1926.602(d). 29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. Throughout the Facility: The employer failed to ensure that written certification for each fork truck operator was written and maintained as outlined in the standard. This should include the dates of training, the instructor names, and the name of the operator. In this case, the dates for training and driver evaluation were unclear and instructor name or names were not listed. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
