29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present using an identity that was referenced on the appropriate material safety data sheet (Construction Reference: 1926.59):  (a)  At the construction site, where the list of hazardous chemicals had not been compiled.  Workers are exposed to dusts potentially containing crystalline silica, polyisocyanurate, iron oxide and formaldehyde when cutting through steel metal decking composed of layers of fire-treated plywood, polysioboard, gypsum and carbon steel.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace (Construction Reference: 1926.59):  (a)  At the construction site, where the material safety data sheet for carbon steel was not maintained.  Workers were potentially exposed to iron oxide and other heavy metals when cutting through the carbon steel with a concrete saw.  (b)  At the construction site, where the material safety data sheet for fire-treated plywood was not maintained.  Workers were potentially exposed to formaldehyde when cutting through the fire-treated plywood with a concrete saw.

29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were conducted by a competent person:  (a)  At the construction site, where the designated competent person had not been conducting regular inspections of the job sites, materials and equipment.  (b)  At the construction site, where the designated competent person was not competent in that he did not know the inhalation and skin hazards associated with cutting through gypsum, fire-treated plywood, carbon steel and polyisoboard, nor did the designated competent person know the measures to be taken to protect employees from these hazardous and dangerous conditions.
