29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):  (a)  at the construction site, where employees apply Titebond Ultimate MP Sealant Translucent, containing 2-butanone oxime, a written hazard communication program had not been developed and implemented.  Contact with 2-butanone oxime causes skin sensitization and severe eye irritation.  Inhalation of 2-butanone oxime causes central nervous system depression.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a)  at the construction site, where the designated competent person performing the frequent and regular inspections of the job site was not competent in that he did not know the hazards involved with the Titebond Ultimate MP Sealant Translucent; did not know the requirements of 29 CFR 1910.1200; and did not know that the parapet wall was of an inadequate height to serve as a guardrail system.
